Titusville, FL Fire Regulations: Outdoor Burning (2026)

Section 9-6(b) lets the fire chief approve special burn permits for large-scale land clearing operations, but only case by case; there is no by-right open-burn allowance for clearing land in the city. Once the chief or a designee approves a site, § 9-6(b)(1) requires a $200 permit fee paid to the fire department and issuance of a city permit that incorporates whatever fire-safety conditions the Florida Division of Forestry and the Titusville Fire and Emergency Services Department set for that burn. Section 9-6(b)(2) then attaches teeth to the permit system: anyone caught burning without a permit, after a violation notice has already been issued, or under a permit that has been revoked, owes a $500 fine for each occurrence, and that fine has to be paid before the burning can continue at all.

Section 9-6(c) lists the associated fee schedule separately, showing a $200 open burn application fee alongside a $200 fireworks application fee, both administered by the fire department. This large-scale permit track is distinct from the small-bonfire allowance in § 9-6(a), which covers social gatherings like cookouts and scout events under simple fire-chief permission with no stated fee; land clearing is expressly carved out of that lighter track and pushed into the permit-and-fee system here. The subsection was added by Ord. No. 33-2021, § 4, adopted November 23, 2021, amending the chapter that was rewritten in full by Ord.

No. 27-2009, § 2, adopted July 28, 2009, which also adopted the Florida Fire Prevention Code (NFPA 1 and NFPA 101) at § 9-1 as the umbrella fire-safety framework these burn rules sit under.
