Troy, MI Fire Regulations: Outdoor Burning (2026)

Troy adopted the 2021 International Fire Code by reference as Chapter 93, and Section 307.1.1, "Prohibited Open Burning," states that "open burning that is offensive or objectionable, as determined by the fire code official, because of smoke or odor emissions or when atmospheric conditions or local circumstances make such fires hazardous shall be prohibited," and separately that "burning for purposes of incineration of waste material including paper, leaves, or any other combustible debris, outside of any structure at any place is prohibited." That waste clause is absolute; no permit lifts it.

Section 307.2 requires a permit from the fire code official before kindling a fire for "recognized silvicultural or range or wildlife management practices, management of prairie grasses and plants, prevention or control of disease or pests, or a bonfire," and only the landowner or their contracted professional may apply. Section 307.3 gives the fire code official or a police official authority to order any open burning extinguished, by the responsible party or the fire department itself, whenever it "creates or adds to a hazardous or objectionable situation." The Troy Fire Department, under Section 103.1, handles fire-prevention inspection and code enforcement citywide.

Section 307.6 carves out one exception: open burning is allowed for firefighter training, public demonstrations, or educational burns run by the fire official or trained fire personnel following accepted practice.
