Eagan adopts the Minnesota State Fire Code for propane (LP-gas). The City of Eagan adopts the Minnesota State Fire Code, including the LP-gas provisions and Appendix O (fires and barbecues on balconies and patios). Under Eagan City Code Chapter 10, Section 10.40, in any structure containing three or more dwelling units with a common hallway or shared means of egress, no person may kindle, maintain, or cause any fire or open flame on a balcony above ground level or on a ground-floor patio within 15 feet of the structure, and no person may store or use any fuel, barbecue, torch, or other similar heating or lighting chemical or device in those locations. The Minnesota State Fire Code (mirrored in Appendix O, Sec. 1.2) reinforces this prohibition, and provides that propane cylinders must be stored outside at least 10 feet from building openings such as windows, doors, and fresh-air intakes. A limited exception allows permanently mounted electric or gas-fired grills plumbed or wired to the building, maintaining 18 inches of clearance, when approved by the fire chief. For single-family homes, propane tanks and cylinders should likewise be kept outdoors, away from building openings and ignition sources, consistent with the State Fire Code and NFPA 58.
Storing or using propane cylinders, grills, or torches on a balcony or within 15 feet of a multi-unit (3+ dwelling) structure violates Eagan City Code Sec. 10.40 and the adopted Minnesota State Fire Code, and is enforced by the Eagan Fire Department through correction orders and citations.
