Eagan, MN Fire Regulations: Fireworks (2026)

Eagan City Code § 6.53 defines consumer fireworks narrowly (wire or wood sparklers up to 100 grams, non-aerial sparking items, snakes, glow worms, smoke devices, and small-charge novelty poppers and caps) and treats everything else, aerial shells, firecrackers, roman candles, skyrockets, and similar devices, as regulated fireworks. Subd. 2 adopts Minn. Stats. §§ 624.20-624.25 by reference and makes it unlawful to sell, possess, use, or explode fireworks outside the consumer-fireworks category without the state permit those statutes require. Subd. 3 requires anyone who wants to sell consumer fireworks at retail to first get a permit from the city fire marshal; the marshal can deny it if the applicant is under 18, was convicted of a fireworks-related violation in the past five years, or had a fireworks license or permit revoked within the past 12 months.

Indoor retail sale is confined to GB, NB, CSC, and PD (retail sales) zoning, never residential, and outdoor sales must also meet the temporary-outdoor-event rules and stay at least 1,500 feet from any other permitted outdoor fireworks stand, with the earliest-filed application getting priority when two sites would otherwise overlap. Overnight storage, 10:00 p.m. to 8:00 a.m., must use a metal container meeting NFPA Standard 1124, smoking is barred within 50 feet of the sales area, and inventory is capped at 50 pounds of net pyrotechnic composition without a sprinkler system or 100 pounds with one.

Subd. 4 bars sale to anyone under 18, throwing fireworks at people, animals, or vehicles, use on public property or streets, indoor discharge, and any discharge between 11:00 p.m. and 8:00 a.m.
