Eagan follows Minnesota's statewide fireworks law (Minn. Stat. 624.20-624.25). Only non-explosive, non-aerial consumer fireworks are legal: sparklers, cones, fountains, snakes, smoke devices, and party poppers. Anything that flies or explodes is illegal statewide. The City further prohibits using consumer fireworks on public property such as parks, roads, alleys, schools, and government property.
Minnesota Statute 624.20, subdivision 1(c), permits only wire or wood sparklers containing not more than 100 grams of mixture per item, and other non-explosive, non-aerial 'sparkling items' containing 75 grams or less of pyrotechnic mixture per tube (or 500 grams or less total for multiple tubes), plus snakes, glow worms, smoke devices, and trick noisemakers such as party poppers, snappers, and drop pops. Everything else listed in subdivision 1(a) is classified as illegal fireworks: firecrackers, bottle rockets, missiles, skyrockets, Roman candles, mortars, shells, and toy cannons using explosives. The City of Eagan's Fire Prevention division reiterates that anything that flies or explodes is illegal in Minnesota, and that consumer fireworks may not be used on public property (parks, roads, alleys, schools, government property). Purchasers must be at least 18 years old with photo ID. Eagan adopts the Minnesota State Fire Code by reference, and aerial or explosive fireworks remain banned for sale, possession, and use citywide.
Penalties are set by Minn. Stat. 624.25. A violation involving explosive fireworks of 35 pounds gross container weight or more is punishable by up to 364 days in jail and/or a fine up to $3,000. Violations involving less than 35 pounds of explosive fireworks, or any amount of non-explosive fireworks, are punishable by up to 90 days in jail and/or a fine up to $1,000.
