Eagan requires a free annual recreational fire permit (City Code Sec. 10.40, Subd. 6) before any backyard fire pit is used. Pits must sit at least 25 feet from homes and flammable structures and 10 feet from property lines, may not exceed 3 feet in any dimension, and cannot be placed on flammable decks or patios.
Under Eagan City Code Chapter 10, Section 10.40, Subdivision 6, no recreational fire may be burned without first obtaining a recreational fire permit from the City. The permit is free, valid for the calendar year of issuance through December 31, and renewable annually. Per the City's published rules, the fire pit or container must be placed a minimum of 25 feet from any home or other flammable structure such as a deck, fence, or shed, and at least 10 feet from all property lines. The pit must be constructed of and completely surrounded by non-combustible materials, and cannot be used on wood, composite, or otherwise flammable decks or patios. The fire itself may not be more than three feet wide, three feet long, or three feet high. Only cut and split, clean, unpainted, untreated wood or cooking charcoal may be burned. A person age 18 or older must attend the fire at all times, a working garden hose and/or an approved fire extinguisher must be within arm's reach, and fires may not be lit or continued when winds exceed 15 mph. The Fire Chief may revoke a permit after two or more violations within a 12-month period.
Burning without a valid permit, or violating the size, distance, fuel, attendance, or wind conditions, is a City Code violation enforced by the Eagan Fire Department. The Fire Chief has authority to revoke a recreational fire permit when a permit holder accumulates two or more violations within a 12-month period.
