Queen Creek enforces the 2021 International Fire Code and 2021 International Residential Code (Ordinance 797-22, effective January 1, 2023), which require smoke alarms in each bedroom, outside each sleeping area, and on every story. Arizona A.R.S. 36-1637 separately requires an approved smoke detector in every new and remodeled residential unit, maintained by the tenant.
Queen Creek does not publish a separate smoke-detector ordinance; the requirement comes from the adopted building and fire codes plus state law. Under those codes, smoke alarms must be installed in each sleeping room, outside each separate sleeping area in the immediate vicinity of the bedrooms, and on each additional story of the dwelling, including basements; in new construction they must be hardwired with battery backup and interconnected so that activating one alarm sounds all. Separately, Arizona A.R.S. 36-1637 requires that an approved smoke detector be installed during construction in each new residential housing unit in the state, and that a smoke detector installed in a new or remodeled unit be maintained and kept operable by the tenant unless the tenant notifies the landlord in writing of a malfunction. Carbon monoxide alarms are also required by the residential code in dwellings with fuel-burning appliances or attached garages.
Smoke-alarm requirements are enforced through the Town's building and fire codes administered under Town Code Chapter 7 and Chapter 18. Failure to provide required alarms can block a certificate of occupancy and constitute a fire-code violation; under Section 9-4-3, violating the Town Fire Code is generally a Class 1 Misdemeanor. For rentals, landlords must keep units in a fit and safe condition under the Arizona Residential Landlord and Tenant Act.
