Section 9004 bars driving or parking motorcycles, motor scooters and motor vehicles on fire roads or firebreaks beyond a cable, gate or sign without the property owner's permission, and requires aerials and guy wires to sit 16 feet or more above them. Section 9005 requires a permit from the fire code official before operating those vehicles in a wildfire risk area except on clearly established public or private roads, and the property owner's permission must be presented with the request. Defensible space is set separately by CFC Section 304.1.3: a firebreak clearing flammable vegetation for not less than 30 feet on each side of a building or to the property line, whichever is nearer, and an additional zone out to 100 feet where state law or local rule requires it.
