Chapter 256, Peddling and Soliciting, governs mobile food sales. Code § 256-9 requires any prospective vendor of food or beverage, on top of the base vending license required by § 256-1, to separately apply to the Long Branch Health Department and, if the Fire Official decides it applies, to the Fire Prevention Bureau. The base license runs through the Supervisor of Mercantile Licenses at an annual fee of $100 per vendor plus $25 per additional employee, and requires a public liability insurance policy of at least $100,000 naming the City as an additional insured.

Article II of the chapter, adopted in 1971, then layers on a location ban specific to food sales: § 256-15 bars selling seafood, ice cream, peanuts, candy, frankfurters or other wares from a wagon, cart or vehicle on Ocean Avenue itself, or on any street within 100 feet west of it, and separately bars itinerant vendors from selling within 100 feet of Ocean Avenue's west side. , and a vendor cannot leave a stand behind or hook into utilities on a property once that window closes.

Enforcement runs through the Police Department, the Health Officer, the Construction Code Official and the Zoning Officer under § 256-10, and a stand left overnight on private property needs Planning Board or Board of Adjustment site plan approval under Chapter 345, § 345-14.
