Under Code § 256-8, the prohibited-practices section of Chapter 256, Peddling and Soliciting, a licensed vendor's stand on a sidewalk must sit right at the curbline when selling food, beverages, goods or merchandise, rather than blocking the walkway itself. Additional placement limits in the same section keep stands at least 30 feet from another vendor already selling there, at least 20 feet from an entranceway to a building, store, theater, library, school, museum, movie house or other place of public assembly, and away from a business's display windows.
Stands must also stay at least 25 feet from a fire hydrant, fire escape, bus stop, loading zone or driveway, at least 10 feet from an intersecting street or sidewalk or a depressed curb cut, and cannot reduce a clear pedestrian path below four feet or a vehicle lane below 15 feet. A stand may not sit on a street posted above 25 miles per hour, and carts are capped at two feet wide, four feet long and four feet high including wheels. Vending on the boardwalk promenade between Laird Street and Seaview Avenue, on part of Ocean Avenue, in any city park, or anywhere in the Redevelopment Zone additionally needs permission from the city's Redevelopment Agency.
