Section 110.21 makes it unlawful to operate, use, or maintain any vehicle, motorized or not, for food delivery purposes unless it has secured a food delivery license and passed all required health and safety inspections. The section splits licensing into two categories: a mobile food vending vehicle, which sells or serves previously prepared food enclosed or wrapped in individual portions, plus coffee, other beverages, and whole uncooked fruits and vegetables to the public; and a mobile food preparation vehicle, on which food is actually prepared and then sold or served to the public.

Both categories are subject to the same rules and regulations found elsewhere in chapter 110, including the general licensing procedures in sections 110.02 through 110.04 that route applications through the director of finance. The village's fee schedule under section 41.01 sets the mobile food vending fee at $115.00 and the mobile food preparation fee at $190.00, reflecting the added health inspection burden of on-board cooking. Because chapter 110's licensing scheme is the general licensing framework for the village, an operator seeking to license a truck must also meet section 110.03's application requirements, including name, address, and business location, and can be denied a license under section 110.25 for failing to provide required information or for a history of violating village, state, or federal law.
