Schaumburg follows Illinois common law regarding shared boundary fences. There is no Village ordinance requiring neighbors to share the cost of a boundary fence. Property owners who install fences must keep them on or inside their own property line. Disputes over fence location are civil matters.
Schaumburg does not have a mandatory cost-sharing ordinance for boundary fences between neighbors. Under Illinois law, a property owner who wishes to install a fence is responsible for the full cost and must ensure the fence is located on or inside their own property line. A plat of survey is recommended before fence installation to avoid encroachment disputes. If both neighbors agree to share a fence on the boundary line, that agreement should be documented in writing. Fence maintenance is the responsibility of the fence owner. If a neighbor's fence falls into disrepair and creates a code violation (blight, safety hazard), Code Enforcement may require the owner to repair or remove it. Boundary disputes are civil matters resolved through the courts, not Village enforcement. Contact Community Development at (847) 895-4500 for fence regulations.
The Village does not adjudicate neighbor fence disputes over cost-sharing or boundary location. Fences that violate code standards (height, materials, condition) may be cited with fines of $50 to $250.
