1D governs where a mobile food vehicle or pushcart may set up once a vendor vehicle permit is issued. Subsection D(4) states plainly that mobile food vehicles are not permitted on public sidewalks at all; only pushcarts, the smaller carts moved without a motor, may use a sidewalk, and even then a clearance of not less than five feet wide must remain open on the sidewalk where the pushcart sits. The same subsection requires every mobile food vehicle unit to keep a ten-foot distance from the nearest building, other vehicles and combustible materials, and a two-foot distance from curbs, while all vendors must hold any legally required distance from crosswalks, curb cuts, sidewalk benches, bike racks, bus shelters and stops and other obstructions.

Violations & Fines
A pushcart or mobile food vehicle blocking a sidewalk, crosswalk or bus stop, or a truck operating on a sidewalk in violation of § 254-2.1D(4), is a chapter violation carrying the § 1-4 forfeiture of $5 to $500 for a first offense and $10 to $1,000 for a repeat offense within a year. The Police Department or Department of Public Works may remove obstructing equipment and bill the vendor for removal, towing and storage.
