Lafayette Municipal Code Section 4.02.040(A) generally makes it unlawful to engage in cafe activity, meaning retail sale of beverages or food on a public sidewalk, without registering with the City Controller. The section then carves out mobile vending: retail sales of beverages or food may occur from mobile vending carts or stands operated pursuant to permission granted by the Lafayette Redevelopment Commission, except in a sidewalk sales area for which a registration has already been granted under Chapter 4.02. A second path lets a vendor sell on a temporary basis if the Board of Public Works and Safety grants written permission that is filed with and approved by the City Controller.

Because they are exempt from the registration process, mobile cart and stand operators approved by the Redevelopment Commission are not required to obtain a solicitor license, comply with the sidewalk-sale restrictions of Sections 4.02.010 and 4.02.020 to the extent those conflict with cafe activity, or get an encroachment license for an awning or canopy that stays within the cart's operating area, per Section 4.02.040(B).
