Summary
Sheboygan does not map vending zones for food trucks; Sec. 78-101 limits where a licensed mobile food vehicle can stand by distance. It cannot park, stop or operate adjacent to or within a 100-foot radius of a licensed food establishment whose kitchen is open, or within 500 feet of a city-licensed or sanctioned fair, festival or other event, absent a waiver or permission.
(b) No person shall park, stop, or operate a mobile food vehicle, nor shall any mobile food vehicle vendor permit any person to park, stop or operate a mobile food vehicle in a location adjacent to or within a 100-foot radius of the nearest edge of any building or section of a building comprising a licensed food establishment, excluding any patio, awning, or temporary enclosure attached thereto, the kitchen of which is open for serving food to patrons. ... (f) No person shall park, stop, or operate a mobile food vehicle, nor shall any mobile food vehicle vendor permit any person to park, stop or operate a mobile food vehicle in a location within 500 feet of the boundary line of any property upon which a fair, farmer's market, festival, carnival, circus, special event, or civic event licensed or sanctioned by the city is occurring, except when the vendor has obtained a permit or otherwise properly obtained permission to do so.
Full Breakdown
Section 78-101 applies to any mobile food vehicle within a public right-of-way or on public property in the City of Sheboygan, and subsection (b) sets the first buffer. No person shall park, stop or operate a mobile food vehicle, and no vendor shall permit anyone to do so, adjacent to or within a 100-foot radius of the nearest edge of any building or section of a building comprising a licensed food establishment whose kitchen is open for serving food to patrons. A patio, awning or temporary enclosure attached to the building is excluded from the measurement. The 100-foot requirement is waived if the vendor's most recent license application was submitted together with the written consent of the proprietor of the adjacent licensed food establishment.
Subsection (c) makes the distance enforceable on the street: every vendor must keep on the vehicle, at all times, a measuring wheel with a measuring capacity of no less than 500 feet, available to anyone working on the vehicle and to any police officer or other municipal official enforcing the article.
Subsection (f) adds an event buffer. No person shall park, stop or operate a mobile food vehicle within 500 feet of the boundary line of any property on which a fair, farmer's market, festival, carnival, circus, special event or civic event licensed or sanctioned by the city is occurring, except when the vendor has obtained a permit or otherwise properly obtained permission to do so.
Other location rules follow the same section. Subsection (d) requires vendors to follow all parking and traffic laws, and a vehicle long enough to occupy all or part of two marked parking spaces can use both if it observes every other parking restriction, including feeding both parking meters. Subsection (h) says the article does not supersede or repeal any ordinance on noise, park closing hours or parking, so the park hours in Sec. 74-41 still apply to a vendor inside a city park.
Violations & Fines
Under Sec. 78-104, any violation of the mobile food vendor article carries a forfeiture of not less than $100.00 nor more than $1,000.00, together with the cost of the action. The common council can suspend or revoke the license under Sec. 78-103 after notice and hearing if the holder violates any provision of the article.
