Full Breakdown
Section 155-10 of the Stafford Township Code controls where a permitted vendor can stand. Subsection C bars vending within 200 feet of any school, church, synagogue or other house of worship while the same is in session. Subsection J bars placing a vending unit within 500 feet of any location already being used by another vendor or an established merchant. Two more subsections limit the spot itself. Under H, no vendor holds an exclusive right to any location in the public streets, and none can vend from a permanent public location. Under I, no vendor is permitted to operate in any area where the operation might unreasonably impede traffic, jeopardize the public's health, safety or welfare or create a public nuisance.
Private property is governed by § 155-11. A vendor who sells goods from a moving vehicle cannot vend from private property without the written consent of the private property owner. The vendor must have that consent in his or her possession and produce it on request from the Stafford Township Police Department or another law enforcement officer of the Township. The vendor also cannot leave the vehicle on private property overnight to attract customers during the hours outside the permissible vending window set in § 155-10A, which is 7:00 a.m. to 7:00 p.m. Section 155-11D exempts an individual who operates out of a fixed structure and holds all the permits and approvals the Township requires for a business in that structure.
Food vendors working from trucks, vans, trailers, carts or bicycles must also satisfy Chapter 223. Section 223-7A requires a Township license for any mobile retail food establishment, with a charge of $100 for each license, and § 223-8D subjects mobile food units to inspection whenever the Township deems it necessary and at the locations the Township directs.
Violations & Fines
Under § 155-13, a Chapter 155 violation is punishable by a fine of not more than $1,000, imprisonment for up to 90 days, community service of not more than 90 days, or a combination set by the Municipal Court Judge, and each day is a separate offense. The Chief of Police can revoke a permit for continued violations. The Police Department, Code Enforcement Officer or Zoning Officer enforces the chapter, and a violation is also subject to summary abatement by restraining order or injunction.
