Full Breakdown
Township Code § 211-35.1, added by Ordinance No. 2022-07 on 4-12-2022, implements P.L. 2021, c. 171. Under C(1), an application solely for EVSE or make-ready spaces is a permitted accessory use and structure in all zoning or use districts and needs no variance. At an existing gasoline station, retail establishment or other existing building, C(5) skips site plan and land use board review and approves the installation through a zoning permit from the administrative officer, provided it respects the bulk requirements and prior approvals and complies with the State Uniform Construction Code. All installations remain subject to local and Department of Community Affairs permit and inspection requirements.
New development carries make-ready duties as a condition of preliminary site plan approval. A multiple dwelling with five or more units must prepare at least 15% of required off-street spaces as make-ready spaces, install EVSE in one-third of them, add another third within three years of the certificate of occupancy and the final third within six years, with at least 5% of the EVSE accessible for people with disabilities. Other parking lots and garages install one make-ready space for 50 or fewer spaces, two for 51 to 75, three for 76 to 100, four for 101 to 150, and at least 4% of total spaces above 150. A retailer with 25 or fewer off-street spaces and the owner of a single-family home are exempt. A space with EVSE counts as at least two spaces toward the minimum, a reduction of no more than 10% of required parking.
Design standards in F set each non-accessible space at not less than nine feet wide or 18 feet in length, outlets between 36 and 48 inches off the ground, and green painted pavement or curb markings for public spaces. Public municipal EVSE carries a usage fee of $0 to $2 per hour for up to two hours and $0 to $5 per hour afterward, set by resolution. The Township names two public EVSE spaces, at 260 East Bay Avenue and 775 East Bay Avenue, monitored by the Police Department.
Violations & Fines
Under § 211-35.1(F)(3)(c), parking or standing a nonelectric vehicle in a publicly-accessible EVSE space, or parking an electric vehicle there without connecting it, violates the section and is subject to fine and/or impoundment as described in the general penalty provisions of the Municipal Code or § 130-106. The Code Enforcement Officer and/or the Zoning Official enforce the signage and installation requirements, and failure to comply draws the same enforcement and penalties as other land use violations. Chapter 211's own penalty section, § 211-36, sets a fine of $100 to $1,250.
