Full Breakdown
Two chapters of the Stafford Township Code reach commercial and oversized vehicles in residential neighborhoods, and they draw the weight line in different places.
Chapter 201 (Vehicles and Traffic), § 201-7B, covers streets. No person, firm or corporation can park a truck, tractor, trailer or omnibus weighing more than 12,000 pounds on any street in any residential zone in the Township, at any hour. The same subsection bars parking a trailer on a residential street under any circumstances if it is unattached or not connected to a towing vehicle as N.J.S.A. 39:4-54 requires for highway operation. Section 201-7C keeps any vehicle designed to transport flammable or toxic substances, and carrying them, from parking within 200 feet of a residential zone, except when delivering to a residential dwelling and then only for the time necessary to make the delivery. Section 201-7E protects deliveries of merchandise or other property to premises on the street, public utility company parking for construction, installation, operation and maintenance, and vehicles attending to an emergency.
Chapter 211 (Zoning), § 211-35F(6), reaches private driveways as well as streets and uses a lower weight line. No commercial vehicle with a gross vehicle weight of 7,000 pounds or greater can be parked on the street or in a driveway in any residential zone, except to make deliveries or provide services to or for residents on that street. Commercial vehicles of that weight engaged in construction activities can be parked or stored on an active construction site in a residential zone. The subsection was amended 8-21-2001 by Ord. No. 2001-54.
Section 211-35F(8) sends storage of tractor trailers and commercial trailers to § 211-35Z. That subsection bars storing or using a tractor trailer or commercial trailer as a storage facility on any property in the Township, with a drop-trailer exception of a maximum of 72 consecutive hours for a trailer stationed adjacent to a commercial business to deliver perishable goods.
Violations & Fines
Section 201-7H sets the Chapter 201 penalty: on conviction, a fine of not more than $1,000 or imprisonment for a term not to exceed 90 days, or both, in the judge's discretion. Each successive day of a continuing violation is a separate offense, and a person allowing or permitting the continuation can be punished for each one. Section 211-35F(6) itself prints no separate penalty.
