Section 27-308(a) allows no more than two garage sales per calendar year on residentially zoned property without first obtaining a conditional use permit from the City Council, and defines a garage sale as offering moveable personal property for sale on any portion of the property. Because the section counts each successive day of an offering as an additional sale, the practical limit is four days per year of sale activity before conditional use approval is required; a two-day sale held twice in the same year already uses the full allowance.

Subsection (b) puts the City Clerk in charge of tracking every advertised garage sale in the city and maintaining a list by common address, and directs city employees who patrol residential streets, including police, building department, and contract utility meter personnel, to report sales they observe back to the Clerk weekly. The Clerk issues citations to any occupant whose property has more than four days of advertised or observed sale offerings in a calendar year, and the code allows referral to the Code Enforcement Board or the city prosecutor for a mandatory inspection, plus injunctive relief; the section legislatively declares excessive garage-type sales a nuisance for that purpose, and makes the violator responsible for the City's attorney's fees and court costs in seeking an injunction.

Subsection (c) further limits what can be sold: only used goods normally found in a residential home, such as clothing, furniture, fixtures, appliances, toys, and bikes; no new, unused merchandise may be offered. A confirmed violation under subsection (d) bars the occupant from applying for or holding any garage sale permit for one year per violation.
