Full Breakdown

Chapter 14A, the Historical Preservation Ordinance adopted by Ord. No. 82-41 in 1982, applies only to areas and sites the city council designates by resolution (Sec. 3). The seven-member historical preservation advisory commission, appointed by the mayor and confirmed by the city council under Sec. 5, recommends sites for designation, reviews alteration-permit applications, and maintains the local historical register. Sec. 6 sets five alternative designation criteria: a property qualifies if it reflects the city's cultural, social, economic, political, aesthetic, engineering or architectural history; is identified with historically significant persons or events; embodies distinctive construction characteristics or the use of indigenous materials or craftsmanship; represents the notable work of a builder, designer or architect; or is found by the council to hold other significant characteristics warranting protection.

Once designated, Sec. 1 lets the council adopt preservation incentives, and Sec. 2 authorizes Mills Act property-tax reduction contracts running at least ten years for owners who commit to repair, restoration and maintenance. Owners of a designated site must keep all exterior portions, and any interior portions subject to control, in good repair, with the building department enforcing that duty (Sec. 12). Any exterior alteration undertaken contrary to the chapter can be ordered stopped in writing by the building director (Sec. 13).

Violations & Fines

Violating any provision of Chapter 14A, including altering a designated structure without authorization or ignoring a stop-work notice, is a misdemeanor under Sec. 14A.13 punishable by a fine up to $500.00, up to six months in jail, or both, with each day of a continuing violation charged as a separate offense; any such violation is also declared a public nuisance.

Frequently Asked Questions

How does a property get designated a historical landmark in Oceanside?
The city council designates an historical area or site by resolution under Sec. 14A.6 if it meets one of five criteria, such as reflecting the city's architectural or cultural history or being tied to significant persons or events; the Historical Preservation Advisory Commission reviews and recommends sites first.
Can I get a property tax break for owning a historic home in Oceanside?
Yes. Sec. 14A.6.2 allows the city council to enter a Mills Act Program agreement with owners of a qualified historic property, reducing property taxes in exchange for at least a ten-year commitment to repair, restoration and maintenance under a resolution-based application process.
What happens if I alter a designated historic building without approval?
The building director can order the alteration stopped in writing under Sec. 14A.13, and continuing the work after that notice is unlawful; any violation of Chapter 14A is a misdemeanor punishable by up to a $500 fine, six months in jail, or both, with each day counted as a separate offense.
Who sits on Oceanside's historic preservation commission?
Sec. 14A.5 sets seven unpaid members appointed by the mayor and approved by the city council, including a licensed architect, a licensed civil engineer or structural rehabilitation specialist, someone knowledgeable in local history, a long-time resident owner, and three general city residents.
