Under California Civil Code 4765, HOA architectural review procedures must be in writing, fair, reasonable, and follow published standards. Decisions must be made in good faith, not arbitrarily, and provided to the applicant in writing with reasons for denial. Members have a right to reconsideration by the board. Solar panels enjoy strong protection under Civil Code 714 (Solar Rights Act). Accessory dwelling units (ADUs) cannot be unreasonably prohibited by HOAs under Civil Code 4751. Arbitrary denials are subject to legal challenge. Violations of Civil Code 4765 can result in court-ordered approval and attorneys fees.
