California HOA assessments are governed by Civil Code 5605. Regular increases over 20 percent or special assessments over 5 percent require member approval.
Under California Civil Code 5605, an HOA board may not raise regular assessments more than 20 percent or levy special assessments exceeding 5 percent of budgeted gross expenses in a fiscal year without member approval by majority of a quorum. Emergency assessments for imminent threats may be imposed by board action alone. Delinquent assessments accrue late charges (up to 10 percent or 10 dollars, whichever greater), interest (12 percent per annum after 30 days), and collection costs. Liens and foreclosure remedies under Civil Code 5700-5720 apply.
