Stockton HOA assessments follow CA Civil Code 5600-5740. Special assessments over 5 percent of the budget need member approval. Foreclosure requires debts over $1,800 or 12+ months overdue.
Under CA Civil Code 5600-5740, Stockton HOAs must adopt an annual budget and distribute it to all members 30 to 90 days before the fiscal year. Regular assessments fund common area maintenance, insurance, and reserves. Special assessments exceeding 5 percent of the current annual budget require approval by a majority of the membership at a noticed meeting. Emergency special assessments for immediate safety threats may be imposed by the board without a vote but must be reported within 30 days. Late payment penalties cannot exceed 10 percent of the delinquent amount or $10, whichever is greater (Civil Code 5650). Interest on delinquent assessments is capped at 12 percent annually. Before recording a lien, the HOA must provide at least 30 days written notice of intent (Civil Code 5660). Nonjudicial foreclosure is prohibited unless the delinquent amount exceeds $1,800 or the assessment is more than 12 months overdue (Civil Code 5720). Boards must conduct a reserve study at least every 3 years.
