Homeowners associations covering single-family lots in Bexar County are governed primarily by the Texas Residential Property Owners Protection Act, codified at Chapter 209 of the Texas Property Code. Condominium regimes are governed by the Texas Uniform Condominium Act at Chapter 82. Under Section 209.0051, HOA board meetings must be open to property owners except for narrowly limited executive sessions covering personnel, pending litigation, contract negotiations, enforcement matters, or confidential information. Boards must provide at least 72 hours advance notice of regular meetings through a method reasonably designed to provide notice, which in master-planned communities north of San Antonio typically means posting on the association website and emailing owners. Minutes must be made available to members. Chapter 209 also requires associations to record a management certificate in Bexar County real property records identifying the current management company, mailing address, and website, and to file the same information with the Texas Real Estate Commission. Boards must follow the association bylaws for quorum, voting, and election procedures, and SB 1588 enacted in 2021 strengthened owner rights around elections and access to records.
Closed meetings held in violation of 209.0051, failure to record a management certificate, or refusal to allow member inspection of books and records can result in court orders compelling compliance plus attorneys fees. Owners may also seek injunctive relief under Chapter 209.
