Jupiter HOAs enforce CC&Rs via written notice, opportunity to cure, and hearing before a 3-member fining committee per FL ยง720.305(2). Fines capped at $100/day and $1,000 aggregate unless governing documents say otherwise.
Before imposing a fine or suspension, the HOA must provide 14-day written notice and an opportunity for a hearing before a committee of non-board members. The committee must approve fines by majority vote. HOAs may suspend common-area use rights for violations and for delinquencies over 90 days. Selective enforcement is a recognized defense under Florida case law.
HOAs failing procedural requirements may have fines invalidated. Owners may sue for declaratory relief and damages.
