Full Breakdown

Section 8-4-5-4 applies whenever open space or other common areas within a subdivision or development are to be owned and maintained by a property owners' association. Before the City will approve a final development plan or site plan, the owner or developer must file a declaration of covenants, conditions, and restrictions governing that association. The declaration is required to establish the property owners' association before any homes or lots in the project are sold, so buyers cannot close before the HOA legally exists. Membership in the association is mandatory for every initial lot or home buyer and for each successive buyer who later purchases in the development, meaning the obligation runs with the property rather than attaching only to the original purchaser.

Any open space restrictions the declaration creates must be permanent rather than limited to a set number of years. The declaration must also make the association responsible for carrying liability insurance, paying local taxes on association-owned property, and maintaining recreational facilities and other common improvements, so those obligations cannot be left undefined or shifted informally onto the City or individual owners.

Violations & Fines

The City enforces this section at the development-approval stage, not after the fact: the Director will not approve a final development plan or site plan for a project with association-maintained common areas unless the required declaration is on file establishing the association and its mandatory-membership terms before lot sales begin. A project that proceeds without a compliant declaration is subject to Chapter 10 enforcement, including withholding of further permits under Section 10-1-2-2.

Frequently Asked Questions

Does Arvada require a new subdivision to form an HOA?
Only when the project includes open space or common areas that a property owners' association will own and maintain. In that case, Section 8-4-5-4 requires a recorded declaration establishing the association before any home or lot in the project is sold.
Is HOA membership optional for buyers in an Arvada subdivision?
No. Section 8-4-5-4(B)(2) requires the declaration to make membership mandatory for each lot or home buyer and any successive buyer, so the obligation transfers automatically with the property at resale.
What must an Arvada HOA declaration cover besides membership?
It must make the association responsible for liability insurance, local taxes, and maintenance of recreational and other common facilities, and it must make any open-space restrictions permanent rather than limited to a period of years, per Section 8-4-5-4(B).
