Summary

Every residential and mixed-use planned unit development in Schaumburg must file homeowners' association documents before the village approves it. Village Code § 154.109 requires covenants covering shared maintenance, easements and common architectural themes, and mandates the HOA's governing documents meet the Illinois Condominium Property Act or, where that Act doesn't apply, the village's own published HOA guidelines.

(A)Submission of Documents: All residential PUDs and mixed use PUDs shall be approved subject to the submission of legal instruments and/or documents governing the association as well as the maintenance of open spaces and other commonly owned facilities. The documentation shall include, but not be limited to:(1)All association documents;(2)Covenants and/or agreements clearly defining the following:(a)Shared maintenance of common open spaces.(b)Shared maintenance of stormwater management areas and other utilities.(c)Shared/cross access and parking agreements.(d)Any easement information or agreements.(e)Common design elements including integration of common architectural themes.(B)Document Compliance: The homeowners' association documents shall be in compliance with and in no case less restrictive than the provisions set forth in the Illinois Condominium Property Act. In those instances where the PUD is controlled by a homeowners' association and not regulated by the Illinois Condominium Property Act, the homeowners' association documents shall comply with the provisions and guidelines regulating homeowners' associations published periodically by the village.

Full Breakdown

Schaumburg does not license or govern homeowners' associations directly; it regulates them as a condition of approving the planned unit development (PUD) they sit inside. ' The list is not exhaustive but must include all association documents plus covenants that spell out shared maintenance of common open space, shared maintenance of stormwater management areas and utilities, cross-access and parking agreements, easement information, and common design elements integrating shared architectural themes across the development. Subsection (B) then sets the legal floor for those documents: they 'shall be in compliance with and in no case less restrictive than' the Illinois Condominium Property Act.

Where a PUD is run by a homeowners' association that the Condominium Property Act does not reach, its documents instead have to match guidelines on homeowners' associations that the village publishes and periodically updates, giving Schaumburg an ongoing say in HOA governance even after the PUD is built. 110, ranging from an administrative sign-off by the village manager for minor edits up to village board approval for extensive changes.

Violations & Fines

Section 154.109 sits inside the PUD approval process rather than a standalone licensing scheme, so noncompliance blocks approval rather than triggering a standalone fine: the village will not approve a residential or mixed-use PUD without acceptable association documents on file. Where a completed PUD's HOA documents fall out of compliance with the Illinois Condominium Property Act or the village's published guidelines, the Village Code's general penalty, § 10.99, applies: $100 to $50,000 per violation, with each day counted separately.

Frequently Asked Questions

Does Schaumburg require HOA bylaws to follow a specific law?
Yes. Section 154.109(B) requires homeowners' association documents to comply with, and be no less restrictive than, the Illinois Condominium Property Act. If a PUD's association isn't covered by that Act, its documents instead have to match the guidelines on homeowners' associations that the Village of Schaumburg publishes periodically.
When does a Schaumburg PUD have to submit HOA documents?
Before the village approves it. Section 154.109(A) makes submission of the association's governing documents, covenants and agreements a precondition of approving any residential planned unit development or mixed-use planned unit development, not a step completed after construction begins.
Can an HOA change its governing documents after a Schaumburg PUD is built?
It can, but changes touching shared maintenance, easements or common architectural themes tie back into the PUD itself, so they can require review as a PUD amendment under § 154.110, ranging from an administrative sign-off for minor edits to full village board approval for extensive changes.
