California's Cottage Food Law (Health and Safety Code Sections 113758-114365) allows Encinitas residents to produce and sell certain non-potentially hazardous foods from their home kitchens. Class A cottage food operations sell directly to consumers at the home, farmers markets, or community events with annual gross revenue up to $75,000. Class B operations may also sell indirectly through stores, restaurants, and other third-party retailers but require a permit from San Diego County Department of Environmental Health (DEH) and may be subject to kitchen inspections. Approved cottage food products include baked goods, candies, dried fruits, granola, jams, honey, roasted nuts, and other shelf-stable items. Potentially hazardous foods requiring refrigeration (such as items with cream, meat, or dairy fillings) are not permitted. All products must be labeled with the cottage food operation name, address, registration number, ingredients, allergen warnings, and the statement 'Made in a Home Kitchen.' Class A operators self-certify by registering with San Diego County DEH. Food handler training through an accredited program is required. The home kitchen must meet basic sanitation standards. No separate commercial kitchen is required.
Operating without proper registration may result in San Diego County DEH enforcement action. Selling unapproved food products or exceeding revenue limits may result in permit revocation. The city does not separately enforce cottage food beyond standard home occupation rules.
