Perth Amboy, NJ Home Business: Customer Traffic Restrictions (2026)

The definition of HOME OCCUPATION in § 430-5 of the Perth Amboy zoning chapter sets the visitor and traffic limits. The occupation must be customarily carried on in a dwelling unit or an accessory structure, carried on by a member of the family residing there, and clearly incidental and secondary to the residential use. Condition (5) then says no traffic shall be generated by any home occupation which is greater in volume than would normally be expected for solely residential use. Condition (6) caps visitors: no more than two (2) clients, customers, or patrons at any given time on the premises for business or commercial purposes.

In the R-M Residential Zone the cap drops to zero, because no clients, customers, patients, or patrons shall be permitted at any time. Condition (2) limits staff: not more than two (2) persons outside the family shall be employed. Space is limited too. The work must stay wholly within the principal building or an accessory structure and take up no more than one-fourth (1/4) of the total gross floor area of all the buildings on the lot, or of the total gross area of the dwelling unit in the R-M Residential Zone.

The conditional use standards in § 430-58E(4) repeat the two-client cap and the traffic rule, and add parking terms: no more than five (5) off-street parking spaces, including residential parking, shall be required, all parking must be screened behind hedging, landscaping or fencing from the street, and all home-occupation-related parking must use the designated off-street parking facilities. The home occupation also cannot reduce the parking or yard requirement compliance of the detached dwelling. Home occupations are conditional uses in the R-60 and R-M Residential Zones under Article VIII.
