Lawton's zoning code treats home-based child care as a use permitted by right in every single-family zone, starting with the most restrictive one. Section 18-5-3-519(A) lists the uses allowed in the R-1 Single-Family Dwelling District only for the following purposes, and item 10 names family day care home directly alongside item 8, home occupation. Section 18-1-1-106(32) defines a family day care home as a licensed or approved family home operated by no more than one wholly self-employed person residing at and inhabiting the dwelling, providing care and protection for seven or fewer children for part of the twenty-four-hour day, expressly excluding informal arrangements among neighbors or relatives.

Because R-1 is described in Section 18-5-3-518 as the most restrictive residential district, any use it permits by right is automatically permitted in the less restrictive R-2, R-3 and R-4 districts as well, under the general rule in Section 18-1-1-105 that more permissive districts allow the uses of more restricted ones. A family day care home operator still needs the Article 7-7 child care facility permit under Section 7-7-1-702 and the state Department of Human Services license, but does not need a use permitted on review, a variance, or any rezoning action from the planning commission.

This distinguishes a family day care home from a larger day care center, which Section 18-5-8-580 places only in the C-1 Local Commercial District and higher, not in single-family residential zones.
