Alameda allows home occupations in residential zones if the business is incidental to the home and registered with the city. Under AMC §30-2 and §30-4.1b, the use may occupy no more than 50% of the floor area, no more than six customers may be on site at once, and a required-parking garage cannot become business space without a Use Permit.
Alameda Municipal Code §30-2 defines a 'home occupation' as any use customarily carried on within a dwelling, rear or side yard areas, or accessory buildings, by the inhabitants thereof, that is incidental to the residential use of the dwelling and complies with the home-occupation standards (§30-4.1b). The city requires a Home Occupation Registration, which must be completed before applying for a business license and is valid for the life of the business at the registered address (a one-time processing fee applies). Per the city's standards, the home occupation may not exceed 50% of the dwelling's floor space, and no more than six (6) customers may be present on site at any one time. A garage that provides required residential parking may not be converted into a home office or business space; if the business involves use of a garage or accessory building, a separate Use Permit application and public hearing are required. The use must remain incidental and secondary to residential use so that the residential character of the neighborhood is preserved. Operating a home business without registering, exceeding the floor-area or customer limits, or converting a required-parking garage without a Use Permit are zoning code violations. Code Enforcement can issue notices to abate and citations, and the registration/business license can be denied or revoked.
