Davis permits home occupations in residential districts as a use secondary to the dwelling under Davis Municipal Code Section 40.26.150. No more than 25 percent of the area of one floor may be used, and the business must not change the residential character of the home or neighborhood.
Davis Municipal Code Article 40.26 (Special Uses), Section 40.26.150, allows home occupations so that a business may be conducted within a residential dwelling without changing the appearance or conditions of the residence and neighborhood. Standards include: no more than 25 percent of the area of one floor of the residence used for the occupation; no use of utilities or community facilities beyond normal residential use; no equipment or process creating noise, vibration, glare, fumes, odors, or electrical interference detectable off the lot; and no storage or display of goods, supplies, or equipment visible from outside the premises. The occupation must remain clearly incidental to residential use, and the code is administered by the Community Development and Sustainability Department.
A home occupation that exceeds the 25 percent floor-area limit, or produces noise, odors, glare, or off-site impacts, violates Section 40.26.150. The city enforces it, typically starting with a notice to correct, and can abate the use.
