Summary

In the City of San Jacinto, California, a home occupation is allowed in every zone that holds a legally established residence, conforming or nonconforming, under San Jacinto Municipal Code § 17.615.040. The work must happen entirely inside the dwelling, be done by the people who live there, and stay clearly incidental and secondary to the residential use.

A. Where allowed. Home occupations are allowed in all zones with a legally established residence (conforming and nonconforming) in compliance with Article 2 (Zones, Allowable Land Uses, and Zone-Specific Standards). B. Allowed home occupations. Any activity producing income, or intended to produce income, conducted entirely within a residential dwelling by the inhabitants of the dwelling, which use is clearly incidental and secondary to the use of the structure for residential purposes, which does not change the character of the dwelling, and only when conducted in compliance with the applicable locational and operational standards identified in Section 17.615.060 (Compliance with Standards and Conditions), below. C. Number of businesses. If more than one home-based business is conducted at a given site, the aggregate of all home-based businesses shall comply with the standards in this chapter.

Full Breakdown

Chapter 17.615 of the San Jacinto Municipal Code treats a home occupation as a legal commercial enterprise conducted by the occupants of the dwelling, and it allows the use only where it is incidental to and compatible with surrounding residential neighborhoods. Under § 17.615.030 every business must register for a business license under Title 5, so the home occupation is approved through the license rather than through a separate zoning hearing. If a household runs more than one home-based business at the same site, § 17.615.040(C) adds them together and the combined total must meet the chapter's standards.

Section 17.615.040(D) lists the activities that qualify. They include work by artists, sculptors, authors and composers, dressmakers and tailors, barber or beauty services with no more than one customer receiving services at any given time, instruction with no more than one pupil at a time, small electronics repair limited to a maximum weight of 40 pounds per item, family day care under § 17.430.150, and home catering subject to approval of the Riverside County Health Department. The Director can add other similar uses.

The standards in § 17.615.060 set the physical limits. The site must be the principal residence of the person running the business, and no more than one nonresident employee or assistant can be on site at any given time. Not more than one room, or the equivalent of 20% of the floor area of the entire dwelling unit, whichever is greater, can be used. The garage counts, but the garage doors must stay closed at all times.

The Director decides each license application under § 17.615.070, approving with or without conditions, and § 17.615.100 requires a new business license when the activity changes from one allowed activity to another.

Violations & Fines

Under § 17.725.040, any use operated contrary to the Development Code is declared a public nuisance and a violation, and a person is guilty of a misdemeanor punishable by a fine or imprisonment not to exceed 90 days, under Chapters 1.24, 1.28 and 8.44. Violations are strict liability offenses regardless of intent, and breaking a license condition can lead to revocation. Under § 17.725.030 the Director issues notices of violation, stop-work orders and citations.

Frequently Asked Questions

Do I need a permit to run a home business in the City of San Jacinto?
Section 17.615.030 requires every business to register for a business license under Title 5 of the Municipal Code. For a home occupation, the Director then approves the license application with or without conditions under § 17.615.070, so the business license is the approval you need, and it must fit the standards in § 17.615.060.
How much of my house can the business use?
Section 17.615.060(B)(11) caps the business at not more than one room or the equivalent of 20% of the floor area of the entire dwelling unit, whichever is greater. The garage can be used, provided all required vehicle storage is maintained under the Development Code and the garage doors stay closed at all times.
Can I hire employees at a San Jacinto home business?
The site must be the principal residence of anyone engaged in the home occupation, and § 17.615.060(B)(2) permits no more than one nonresident employee or assistant to engage in home occupation activities at the site at any given time. Residents of the dwelling are not counted under that limit.
Who can inspect my home occupation?
Under § 17.615.090 the Director, a Code Enforcement Officer, a Building Inspector or a Riverside County Sheriff Deputy has the right at any time, upon request, to enter and inspect the premises to verify compliance with the standards in § 17.615.060.
