Menifee Development Code Chapter 9.255 distinguishes Home Occupations (administrative offices inside the dwelling, allowed in all residential zones) from Home-Based Businesses (broader operations including outdoor/accessory-structure use, allowed ONLY in Rural Residential zones). Both require a Home Occupation Permit (HOP) approval under Chapter 9.255 AND a Menifee business license under MMC Title 5 Ch 5.01 before commencing operation. The use must remain incidental and secondary to residential use and may not alter the residential character of the dwelling or neighborhood.
Per Menifee Development Code §9.255.030, no home-based business or home occupation may commence operation prior to approval under Ch 9.255 (Home Occupation and Home-Based Business Permits) and registration for a business license under Ch 5.01. §9.255.040 caps employment: home occupations are limited to resident employees only, except beauty shops and large day care uses (which may have one non-resident employee on site at any time); home-based businesses (Rural Residential only) may have not more than one non-resident employee on site. Limits: maximum 2 home occupations per residence; not more than 1 home-based business per property. Where non-resident employees are anticipated, one additional parking space is required. Vehicles used in the business may not exceed two axles or 20 feet in length. State licensed family daycare homes are not subject to home-occupation zoning gates under Cal. Health & Safety Code §1597.45-1597.46 — they are a residential use by right.
Operating without a Home Occupation Permit or business license, exceeding employee caps, operating a home-based business outside a Rural Residential zone, or commercial use that alters residential character can trigger code enforcement under MMC §9.255 with fines and orders to cease.
