Temecula allows home-based businesses in all residential zones under TMC Β§17.04.020 (Home Occupation) when secondary to the residential use. Activities must not change the residential character, generate customer traffic, employ non-residents, or use more than 25% of the dwelling.
Temecula Municipal Code Title 17 (Development Code) permits home occupations in single-family (R-1, L-1, LM), multi-family (M, H), and hillside residential zones, subject to Section 17.04.020. The home occupation must be clearly incidental and secondary to the residential use of the dwelling. Specific limits typically include: no more than 25% of the floor area of the dwelling (or 400 sq ft, whichever is less) used for the business, no employees or workers other than residents of the dwelling, no display or sale of merchandise from the premises, no exterior evidence of the business (no signs, no special lighting, no parked commercial vehicles over 1-ton rating), no storage of hazardous materials, no manufacturing or assembly that produces noise/vibration/smoke/odor detectable beyond the property line, and no customer or client visits except by appointment with limited frequency. Prohibited home occupations typically include auto repair, kennels, medical clinics, restaurants, retail sales, beauty/nail salons with walk-in clients, welding, and large-scale manufacturing. Cottage food and licensed home daycare have separate state-law protections (see those subcategories). All home occupations require a City of Temecula Business License (TMC Title 5) and must comply with state tax/employer requirements. Operating without a license is subject to penalties and back fees.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Temecula code enforcement directly for current fines, enforcement procedures, and hearing options.
