Mount Prospect, IL Homelessness & Encampment Rules: Encampment Sanitation (2026)

Section 23.113, Mendicants or Vagrants, is the provision in the Village of Mount Prospect's Code that speaks to sleeping in public places. It has two sentences. The first makes it unlawful for any mendicant or vagrant to frequent any depot, store, theater, street, alley, sidewalk, park or other public place or any place frequented by the public in the village. The second supplies the definition: any person found sleeping in such places, and who has no established domicile or residence, shall be considered to be a vagrant.

The section itself prints no notice period, no storage-of-belongings procedure and no cleanup protocol. Its reach comes from the list of places and from the domicile test: the status of a person found sleeping without an established domicile or residence is what triggers the vagrant label.

Other parts of the Code cover the conditions that accompany an encampment. Section 23.1403 lists nuisances within the Village and within one-half (1/2) mile of the corporate limits, including piles or deposits of garbage, refuse or trash on public or private property, burning garbage other than in state-approved incinerators (subsection T), burying garbage (subsection U), and causing or allowing garbage or debris to accumulate for more than seven (7) days or to attract flies, vermin or rats (subsection V). Section 23.1404 makes abatement a remedy cumulative to other remedies at law and equity, and it does not bar civil or criminal prosecution.

Section 23.101(B)(12) bars placing or erecting an obstruction of any type on a public way, and Section 23.110(B) bars bonfires on any public street, sidewalk or other public place. Section 23.102(B) reaches a person manifestly under the influence of alcohol, narcotics or other drug on a street, alley or other public place who endangers self or others and fails to cooperate with a police officer in being assisted to a home or treatment facility.
