Mount Prospect, IL Noise Ordinances: Construction Hours (2026)

Section 21.226 defines construction related activity as any use of percussion or power tools, excavation, demolition, the moving of powered construction equipment, and the loading or unloading of construction material or equipment. The rule applies at all locations, and the prohibited hours run from seven o'clock (7:00) P.M. to seven o'clock (7:00) A.M. The only relief is an emergency work permit. If work in those hours is necessary to protect health, safety or property, the owner applies to the village manager, who can issue a permit for the minimum time needed to finish the emergency work, up to a maximum of three (3) days. The permit can be renewed for periods of up to three (3) days while the emergency continues.

Liability is spread wide. The person actually committing the violation, the general contractor, the permittee, the property owner and the property occupier are jointly and severally liable for any violation of the section.

Residential districts get a second rule in § 23.1403.1. Between seven o'clock (7:00) P.M. and seven o'clock (7:00) A.M., within the R-X, R-1, R-A, R-2, R-3 and R-4 districts, it is unlawful to operate any percussion tools, power tools, power lawn tools or power construction equipment. The same section bars driving a commercial vehicle to an address to load or unload it, loading or unloading a commercial vehicle, and running the engine or refrigeration unit of a parked commercial vehicle, with an exception for residential moving vans. The prohibitions do not apply to snow removal, municipal operations or bona fide emergency home repairs.

Noise from these hours also counts under the nuisance article. Section 23.1403(H) makes offensive noise that disturbs the peace of the neighborhood a nuisance and lists § 21.226 and § 23.1403.1 among the provisions it includes. Item I of the same section makes it a nuisance to leave dirt, mud, gravel or rock on public streets after the completion of each day of construction work.
