Section 540.02 states flatly that no person may sleep on public sidewalks, streets, or alleyways at any time, as a matter of individual and public safety, and separately bars sleeping in any pedestrian or vehicular entrance to public or private property that abuts a public sidewalk, closing off doorway sleeping too. Subsection (c) gives officers the power, in addition to any other remedy provided by law, to immediately remove a violator from the premises rather than waiting for a citation to be processed. The section sits inside Chapter 540, Prohibited Camping, enacted by Ord.

171-2025, passed September 15, 2025, which opens with definitions in Section 540.01 clarifying that City Property covers all property, parks, rights of way, parking lots, easements, or other land owned, leased, controlled or managed by the City. While 540.02 targets sleeping specifically, the companion Section 540.03 separately regulates maintaining a Campsite, meaning a person can violate the sleeping ban and the camping-regulation section independently depending on whether they have set up camping materials. Enforcement mitigation is built into Section 540.99: a court must consider, when sentencing, whether the individual removed personal property and litter after being informed of the violation, and whether the individual meaningfully engaged with private resources or service providers between citation and hearing.

The maximum fine for a Chapter 540 violation is capped at $50, with the court retaining discretion to impose alternative, non-incarceration penalties aimed at addressing the reasons behind the violation instead of a fine.
