Canton, OH Fence Regulations: Fence Permit Requirements (2026)

Section 1194.02 of Canton's Zoning Ordinance sets out when a zoning permit is required, and subsection (g) lists fences directly alongside construction of buildings, changes in land use, occupancy of vacant land, and the erection of signs under Chapter 1187 and swimming pools under Section 1140.01. Because no fence-specific size threshold appears in subsection (g), the permit requirement reaches fences generally rather than only fences above a certain height. To obtain the permit, Section 1194.03 requires the property owner or an authorized agent to apply to the Zoning Inspector, and if the application conforms to the Zoning Ordinance, the permit must issue within fifteen days.

Applications for a permit involving new construction or a physical improvement must be accompanied by a plot plan showing the lot's dimensions, the access street, existing structures and abutting lot numbers, based on an actual survey once the location is staked out. Section 1194.04 provides that a zoning permit is revoked by the Zoning Inspector if the permitted work is not substantially completed within one year of issuance. A fee accompanies every zoning permit application under Section 1194.08, deposited to the City's General Fund according to the adopted fee schedule, and Section 1194.09 lets the Director of Public Safety waive that fee for structures owned by a political subdivision or other government entity. The cost of skipping the process is steep: Section 1194.05 triples the required permit fee if the work begins before the permit issues.
