35 makes it unlawful, after a law enforcement officer has notified a person of the prohibition, to sit or lie down on a public sidewalk, or on a blanket, chair, stool or other object placed on a sidewalk, within the Center City Business District. That district is defined as the area bounded by the north side of Kimball Street, the east side of Dundee Avenue and Villa Street, the south side of National Street, and the west side of State Street, including adjacent properties on both sides of each boundary street.

The ordinance requires an officer's notice before a violation can occur, meaning a first-time sitter is warned rather than immediately cited. 030 carves out eight exceptions: medical emergencies; use of a wheelchair, walker or stroller due to age, infirmity or disability; operating or patronizing a sidewalk business under a street use permit; participating in a permitted parade, festival, rally or similar event; sitting on a sidewalk bench or chair supplied by a public or private agency; waiting in an orderly line for shelter entry, social services, or box-office tickets; children in strollers; and constitutionally protected expressive activity, so long as none of these impede pedestrian passage or building entrances.

040 sets penalties at not less than $100 for a first offense, $250 for a second offense within one year, and $500 for a third or subsequent offense within one year.
