Section 23-301 defines a public area broadly to include streets, medians, highways, parks, parking lots or garages, alleyways, sidewalks, pedestrian ways, recreation space, bus stops, train stops, and the common areas of schools, hospitals, office buildings, apartment buildings, and businesses. Section 23-312(a) bars obstructing or encroaching on space designed for foot or vehicular traffic, such as sidewalks and streets, and subsection (b) bars obstructing space designed for pickup and delivery, such as bus stops and alleys. Subsection (c) defines the offense: placing, maintaining, or allowing any object to be placed or maintained so that it impedes free passage across the entire width of the area described in (a) and (b).

Two exceptions apply under subsections (d) and (e): lawfully placed signs, barricades, traffic or pedestrian control devices, and objects placed for utilities or government services are not obstructions, and a property owner's own lawful obstruction of access to private property is exempt. Section 23-313 layers on an affirmative defense for a person resting or sleeping in a parked vehicle for up to four hours while sober. Enforcement sits with the police department, the code enforcement officer, or an employee the city manager designates under Section 23-302, and every violation is a Class C misdemeanor punishable by up to a $500.00 fine, with each day of continued obstruction charged as a separate offense.
