Texas House Bill 2436 (effective 2023) added Texas Property Code Β§ 202.007(e), protecting the right of homeowners to cultivate edible landscaping, including vegetable gardens, on their property. HOAs cannot prohibit food gardens but may impose reasonable aesthetic standards (such as keeping the garden maintained and weed-free). Irving's property maintenance codes require that all landscaping be maintained in good condition, which applies to gardens as well. Gardens that become overgrown or create nuisance conditions (attracting vermin, unsanitary) may be cited under property maintenance codes. Water restrictions still apply to garden irrigation.
