No person, except upon the order of the City Forester, shall plant, remove, spray, brace, trim, prune, cut above or below ground, disturb, alter or do any surgery on a tree or shrub located in the terrace or any public area or cause such an act to be done by others without first obtaining a written permit for such work from the City Forester.(b)No permit shall be required under the provisions of this section to cultivate, fertilize, or water trees and shrubs. No permit is required to plant trees or shrubs inside the property line of private property unless said trees and shrubs obstruct or shade the street lights, obstruct the passage of pedestrians on sidewalks, obstruct vision of traffic signs, or obstruct view of any street or alley intersection.(c)The City Forester shall determine that the proposed tree planting described in the written permit ensures the proper tree size, species, shape, location and conditions, taking into account the health and welfare of the public, location of utilities and availability of a tree planting space before authorizing the planting to proceed.

Neenah Municipal Code § 18-10 puts the City Forester in charge of every public tree: no one may plant, remove, spray, brace, trim, prune, cut or otherwise disturb a tree or shrub in a terrace or public area without a written permit, except on the Forester's own order. That control does not reach onto private land in the ordinary case, § 18-10(b) says no permit is needed to plant or, by extension of Chapter 18's scope, work on trees inside your property line, unless the tree obstructs or shades street lights, blocks the sidewalk, hides traffic signs, or blocks the view at a street or alley intersection. Diseased or hazardous private trees can still be ordered removed as a nuisance under § 18-20 through § 18-23.
