Upland's parkway (parking strip) trees are governed by City code, primarily Chapter 12.24 (Parkways, Parking Strips). The City takes responsibility to maintain, trim and repair trees in the public right-of-way, with the exception of providing water to those trees. The abutting property owner is responsible for supplying water to maintain the growth, health and beauty of the tree, and for trimming away low growth such as suckers and shoots that may interfere with pedestrian or vehicular traffic. Private landscaping must be kept maintained in a reasonable manner — including trimming, weeding, irrigating, fertilizing and mowing — and any private vegetation that overhangs or encroaches on a gutter, sidewalk or street and may impede traffic is subject to enforcement. The code also protects public trees: except to abate a defined nuisance, no person may damage, destroy or mutilate any tree, shrub or plant in a public parking strip or other public place, though owners may trim shrubs and plants in the parking strip under stated conditions. For routine City tree maintenance requests, Public Works handles parkway trees. These are City rules; they are not San Bernardino County standards.
Improperly topping, mutilating, or removing a City parkway tree without authorization can trigger Code Enforcement action and liability for damage under Chapter 12.24. Encroaching private vegetation over sidewalks/streets is abatable as a nuisance.
