Irvington, NJ Landscaping Rules: Weed Ordinances (2026)

Sections 439-28 through 439-30 sit in Chapter 439's Article I, carried forward from the 1981 recodification of Ordinance No. MC 2622. Unlike a lawn-height ordinance that sets a numeric inch limit, Irvington's weed rule is species-based: Section 439-28 declares that permitting ragweed, goldenrod, poison ivy, poison sumac or other noxious or poisonous weeds injurious to health to grow on any lot in the Township is hereby declared to constitute a nuisance. Section 439-29 puts the removal duty on whoever controls the lot, owner, lessee, tenant or occupant alike, requiring the listed weeds to be cleared at that person's own expense within five days of receiving notice from the Township Health Officer.

Section 439-30 spells out how that notice must be served: a written demand signed by the Health Officer, delivered personally, left at the lot-holder's residence with a family member over 14, or, if the owner or occupant is a nonresident, mailed postage-prepaid to their last known address. The Article I fine schedule at Section 439-35 gives Section 439-28 its own escalating penalty, separate from the Township's general default fine, reaching a fourth-offense maximum well above the first-offense amount.
