Full Breakdown
Section 405.02(11) of the Roseville City Code covers weeds and vegetation as a public nuisance affecting public comfort or repose. Subsection (11)a reaches two things. First, all noxious weeds in all locations. Second, turf grasses, nuisance weeds and rank vegetative growth that are not maintained at a height of eight inches or less in locations closer than 40 feet from an occupied principal structure, from any property line with an occupied structure on abutting property, or from a public road pavement edge.
Subsection (11)b lists what the height rule does not apply to: natural areas, public open space or parklands, as determined by the city forester or naturalist designated by the city manager, and yard areas with natural landscaping that follow the city policy for natural landscaping. Subsection (12), Yard cover, adds that the yard area of a lot cannot be bare soil, must be covered by a groundcover and must be maintained as set out in subsection (11).
The building maintenance chapter repeats the figure. Section 906.05(a)(4) requires all premises and exterior property to be maintained free from weeds or plant growth in excess of eight inches, prohibits all noxious weeds as listed by the state department of agriculture, and defines weeds as all grasses, annual plants and vegetation other than trees or shrubs, excluding cultivated flowers and gardens. If the owner or agent does not cut and destroy the weeds after a notice of violation, an authorized city employee or contractor can enter the property, cut and destroy the weeds, and charge the owner.
Section 405.09 provides an accelerated process for tall grasses, nuisance weeds and other vegetative growth under Section 405.02(11): written notice served in person, by posting or by mail states that the nuisance must be abated within five working days, failing which the city abates and certifies the cost against the property for collection with taxes. Section 405.08(b) sets the assessment: the city manager lists unpaid weed abatement charges on or before September 1 for assessment under Minn. Stat. § 429.101, collectible in annual installments not exceeding ten.
Violations & Fines
Section 405.05 makes it unlawful to maintain any public nuisance defined in Chapter 405. After the five-working-day notice under Section 405.09, the city abates and the owner is personally liable for the cost under Section 405.08(a). A Code violation is also a misdemeanor under Section 102.01(a), with a fine not to exceed $1,000.00, imprisonment not to exceed 90 days, or both.
