Section 7.02.063 makes it unlawful to let uncultivated grass, weeds, or brush exceed 12 inches within the city limits, and Section 7.02.061 defines 'brush' as mesquite trees, greasewood, cacti, or other naturally occurring vegetation. Recognized affirmative defenses include land grazed as pasture, cultivated gardens or agricultural use, brush with a trunk girth of ten inches or more, undeveloped lots more than 100 feet from any building and 15 feet from the curb, and developed lots over ten acres at the same distances. Code Compliance issues notice; unabated lots are cleared and liened.
Owners get seven days after notice to clear weeds or brush. The city then abates and files a privileged lien with 10% annual interest. Weeds over 48 inches posing danger may be cut without notice.
