Full Breakdown
Section 118-449 of the Sheboygan Municipal Code applies whenever a bicycle is operated in the city. Subsection (1) puts the rider as near as practicable to within three feet of the righthand curb or edge of the roadway, with due care when passing a standing vehicle, passing one proceeding in the same direction, or making a lefthand turn at an intersection. Subsection (4) requires single file riding on all roadways, sidewalks and other areas where motor vehicle or pedestrian traffic is present.
Other subsections limit how the bicycle is used. It cannot carry more people than it is designed and equipped for, or tow a person or object that is not specifically designed for towing by bicycles (2). A rider cannot cling to a moving vehicle (3), must ride on the permanent seat facing forward with both feet on the pedals (5), and cannot join a race, speed or endurance contest with any other moving vehicle (6). Subsection (7) bars fancy or acrobatic riding and stunts, and riding without at least one hand on the steering apparatus. Subsections (7) and (8) bar operating a bicycle on sidewalks in a business district, and (8) also bars parking one there. Subsection (9) keeps mechanically unsafe bicycles off the public ways, and (10) applies the rules of the road in W.S.A., ch. 346 to every bicycle.
Neighboring sections add to the picture. Section 118-448 requires a white front lamp visible from at least 500 feet and a red rear reflector of at least two inches in surface area for riding in darkness, a working brake, and a bell or device audible for at least 100 feet; a siren or whistle is barred. Section 118-471 requires every bicycle with wheels 20 inches in diameter or over to be registered with the police department, and § 118-472 sets ten days from purchase and delivery. Section 118-480 prohibits bicycling on Broughton Drive and North Third Street between Wisconsin Avenue and Michigan Avenue during LakeFest, the day of the Independence Day celebration and Coho Derby when the area is closed, and § 70-3(e) bans bicycles on municipal boardwalks, with an exception for a wheelchair operated by a physically disabled person.
Violations & Fines
Under § 118-447 the forfeiture for violating Article VIII is $25.00 for ages 12 years and up, and no court costs or witness fees are assessed unless the violator chooses a court hearing. A police officer or parking monitor issues the notice. The violator can stipulate guilt and pay the city finance department, or contest by contacting the police department. After ten days without payment a $10.00 administrative fee is added, and after 21 days another $10.00. A notice cannot be contested once 31 days have passed.
