Yonkers, NY Mobility & Curb Rules: Red-Light Cameras (2026)

§ 109-45, added by Local Law No. 9-2017 and amended by Local Law No. 2-2025, authorizes the Parking Violations Office to run a "demonstration program" imposing monetary liability on vehicle owners, not drivers, when a traffic-control signal photo violation-monitoring system catches a vehicle running a red light in violation of Vehicle and Traffic Law § 1111(d). The Traffic Engineer may operate the cameras at no more than 25 intersections at any one time. Liability attaches to the registered owner regardless of who was driving, unless the operator was convicted separately of the underlying VTL § 1111(d) violation, or unless the vehicle was being used without the owner's consent, a fact the owner must rebut a presumption of consent to establish.

Notices of liability go out by first-class mail and must tell the recipient how and when to contest the charge; failing to respond in time is treated as an admitted liability and can produce a default judgment. Camera images are engineered so they don't identify the driver, passengers, or vehicle contents, though a notice isn't automatically dismissed just because a photo happens to reveal contents. A sworn technician's certificate based on the photos, videotape or other recorded images is prima facie evidence at any hearing. An imposition of owner liability under this section is not treated as a conviction and doesn't appear on anyone's driving record or affect insurance.
