Chapter 313 authorizes the City of New Rochelle to run a demonstration red light camera program. The Police Department and Traffic Engineer may install traffic control signal photo violation monitoring devices at no more than 12 intersections at any one time. The system is engineered so that, to the extent practicable, photographs do not identify the driver, passengers, or vehicle contents, though a notice of liability is not dismissed solely because the images happen to reveal the contents. Liability attaches to the vehicle's owner, defined broadly to include titleholders, DMV registrants, lessors and rental companies, whenever the vehicle is used with the owner's express or implied consent to run a red light in violation of Vehicle and Traffic Law § 1111(d).

A notice of liability is mailed first class and must state the registration number, violation location, date, time and camera or document locator number; failing to contest it within the prescribed time is deemed an admission of liability and can produce a default judgment. Owners face a $50 penalty per violation plus a $25 penalty for failing to respond on time, adjudicated by City Court of the City of New Rochelle. A violation under this section is not a conviction, does not go on the operator's driving record, and cannot be used to raise insurance rates.

Defenses include a malfunctioning signal or a vehicle reported stolen before the violation occurred. Lessors who forward the renter's contact information within 37 days shift liability to the lessee. The Police Commissioner must submit an annual report on camera locations, violations, revenue and accident data to the Governor, Senate, Assembly and City Council by June 1 each year.
