Southaven, MS Noise from Specific Sources: Bar & Nightclub Noise (2026)

The City of Southaven does not single out bars or nightclubs in its noise chapter, so a venue is judged under the general music rule. Section 10-122(14) lists the playing of any music by a live band, or other instruments or devices using sound amplification equipment, in any manner so as to unreasonably disturb the peace and quiet of neighboring persons of ordinary sensibilities in the vicinity as a specific unlawful noise. The general rule in Section 10-121 adds that any loud, unnecessary or unusual noise disturbing the peace is unlawful, and lists the factors weighed: proximity to residential sleeping facilities, nature and zoning of the area, time of day or night, duration and tonal or musical content, and whether the source is a commercial activity.

Events with a permit are treated differently. Section 10-93(2) exempts outdoor gatherings, public dances, shows and sporting and entertainment events provided they are conducted pursuant to a discretionary license or permit by the city. Special condition permits come from the chief of police for a period not exceeding one (1) year at a cost not exceeding $500 (Section 10-143). The application must describe the premises, the dates and times, and designate a responsible person who must be present at all times (Section 10-144).

Section 10-145 sets the outer limit. The chief of police decides within fifteen (15) days of a completed application, weighs prior complaints and the proximity of residential areas, schools and churches, and shall not issue a permit for music under Section 10-122(14) Sunday through Thursday between 11:00 p.m. and 7:00 a.m., or Friday through Saturday between 12:00 a.m. and 7:00 a.m. A denied applicant can appeal to the mayor and board of aldermen within ten (10) days by giving notice to the city clerk, and Section 10-146 lets the chief revoke a permit for a disturbance or a misrepresentation.
